General Acceptable Use Policy

This Acceptable Usage Policy (AUP) outlines the specific way BigCloudy’s hosting and other services can be utilized. It is a condition of service that you comply with this AUP. Any violation of this policy may result in suspension, restriction or termination of your services with BigCloudy. In the event of a dispute about the interpretation of this policy, BigCloudy’s decision, based on fair commercial judgment, will be final. This AUP forms the complete agreement between BigCloudy and you (whether you are an individual or a business account holder). BigCloudy provides managed web hosting, domain registration and related services. As a responsible hosting provider, BigCloudy must comply with legal, security and ethical obligations in operating its servers and infrastructure. BigCloudy reserves the right to suspend or cancel services if we determine that your account is being used inappropriately or in violation of this AUP.

What is Considered Appropriate Usage?

BigCloudy’s hosting services are targeted towards supporting websites for small and medium businesses, individual projects, and startups.

As discussed in the previous section, fair usage is critical because in shared hosting multiple customers are using the same server’s resources. Our hosting is not intended for massive resource heavy applications, high traffic platforms and enterprise level workloads. If your needs surpass the confines of shared hosting, we suggest upgrading to a Virtual Private Server (VPS), Cloud Hosting, or a Dedicated Server for enhanced performance and scalability.

To maintain stability and speed across all accounts:

No single customer should overuse CPU, RAM or bandwidth in a way that impacts others.
BigCloudy actively monitors server performance 24/7/365. If a website is harming server health, BigCloudy may take preventive action, which could include limiting resources, suspending the account, or requiring an upgrade.

Important: BigCloudy hosting accounts are meant for websites only, not for file storage, backups or archiving. Using your account primarily as a personal cloud drive, storage locker or file-sharing hub is strictly prohibited. Our servers are optimized for web hosting, not general data storage.

Offensive Content

You may not host, publish or transmit any content through BigCloudy’s services that:

Promotes or depicts excessive violence, threats, harassment, hate speech or incitement to violence.
Contains child exploitation or pornographic material.
Contains obscene or sexually explicit content.
Is fraudulent, deceptive, or misleading, such as pyramid schemes, phishing pages or chain letters.
Is defamatory, violates privacy or infringes on others’ intellectual property rights.
Endangers public safety, health or national security or interferes with law enforcement investigations.
Intentionally bypasses copyright or digital rights management (DRM) protections.
Promotes or distributes illegal drugs, weapons trafficking, gambling or activities restricted by law.
Is otherwise illegal, malicious or harmful, or may trigger retaliation (such as DDoS attacks) against BigCloudy’s infrastructure.

BigCloudy strictly prohibits the hosting of:

Proxy sites or services
Warez or pirated software distribution
High Yield Investment Programs (HYIP)
Escrow services of suspicious nature
Illegal gambling, lotteries or betting sites
Gaming servers or applications violating licensing laws
Multi-Level Marketing (MLM) or Ponzi schemes

Enforcement: BigCloudy reserves full rights to suspend or terminate services immediately if you host such content. Refunds (if any) will be issued at BigCloudy’s sole discretion.

Bulk Commercial Email & Messaging Policy

BigCloudy allows the use of bulk commercial email, mailing lists and email reflectors on our servers, but we impose fair limits to maintain server performance and prevent abuse.

You may send a maximum of 500 emails per hour per account.
Any bulk emails sent through BigCloudy services must follow these rules:

1. Consent is required: Recipients must have opted in to receive your emails through a clear and verifiable method.

2. Valid ownership: Your process for collecting consent must ensure that the person opting in actually owns the email address.

3. Transparency: You may not hide, falsify or disguise the source of your email.

4. Legal compliance: You must follow the CAN-SPAM Act and any other applicable laws in your jurisdiction.

These rules apply to:

Emails sent directly through BigCloudy’s services.
Emails sent indirectly through other networks that reference or link to a website hosted with BigCloudy.

Additionally, you must not use any third party email service provider that does not follow similar anti-spam and opt-in policies.

Unsolicited Email - Spam

You may not send unsolicited emails (spam), whether in bulk or individually, to anyone who has indicated they do not wish to receive such communications.
You must also comply with the policies and rules of any network you use to send emails via BigCloudy’s services.

Account & Domain Information

You must always maintain accurate and up to date contact details with your domain registrar for any domain hosted on BigCloudy’s network.

Disclaimer

BigCloudy does not have the support resources or the obligation of monitoring client activities. Although we are within our rights to mitigate actions of abuse, our clients are solely accountable for their network and services usage.

Internet Abuse

The following actions are strictly prohibited on BigCloudy’s network:

Unauthorized access. Attempting to hack into, probe, scan or test the vulnerability of systems, networks or accounts (including those of BigCloudy and other customers).
Unauthorized monitoring. Intercepting or monitoring data traffic without the consent of the network owner.
Denial of Service (DoS) / Attacks. Activities such as flooding, mail bombing or deliberate overloads that disrupt services for others.
Account hijacking. Using another person’s account or computer without authorization (including password theft, phishing, port scanning or tricking users into revealing credentials).
Packet forgery. Altering TCP/IP packet headers or email/newsgroup header information.
Retaliatory attacks. Any activity that may trigger counterattacks or retaliation against BigCloudy’s infrastructure.
Interference with others. Using BigCloudy’s network in ways that degrade or unreasonably impact other customers’ ability to use our services.

Forums, Newsgroups, Chat Rooms

When using IRC, USENET and other chat and mailing list services using BigCloudy network, you are required to adhere to the internal policies of each virtual community.

Do not post off topic commercial messages.
Do not spam or post the same message across multiple forums or groups.
Respect the conventions of the group you are participating in.

Security

Security is a shared responsibility between BigCloudy and our customers. While we protect our infrastructure with multiple layers of security, customers are responsible for securing their accounts.

You must:

Use strong, unique passwords for all BigCloudy services
Change your passwords regularly
Secure login information from being accessed without permission
Make sure your website, Content Management System, plugins and any other scripts are updated without delay
Perform malware and vulnerability scans on a routine basis

If you don’t follow or maintain basic security practices, your account could be misused. In such cases, we may suspend it to keep our servers and other customers safe.
