General Terms of Service

These Terms of Service ("Agreement") form a legal contract between BigCloudy, headquartered in India, and You (the "User" or "Customer"). This document governs the use of all products, hosting plans, and services provided by BigCloudy (collectively referred to as the "Services").By signing up for or using our Services, you confirm that you have read, understood, and agreed to be bound by this Agreement. If you do not accept these terms, you must not access or use the Services.BigCloudy reserves the right to suspend, restrict, or cancel access to any of its Services if a customer is found violating these terms, misusing resources, or engaging in activities deemed inappropriate or harmful by BigCloudy.Note: The English version of this Terms of Service (TOS) is the only official and binding version. Translations may be provided for convenience but do not hold legal authority. In the event of any dispute, the English version will prevail.

1. General Rules of Conduct

As a customer of BigCloudy, you agree to comply with the following rules when using our website, systems, and services:

1.1 Compliance with Law and Policies

Your use of BigCloudy's website and Services must comply with this Agreement, any other applicable Service Agreements, and all local, state, national, and international laws. Any content or activity that violates these terms may result in suspension or permanent termination of your account.

1.2 Privacy & Data Collection

You must not collect, attempt to collect, or allow others to collect personal or non-public data of other users without their explicit written consent.

1.3 Prohibited Use of Services

You agree not to use BigCloudy Services in any way that:

Engages in spam, bulk unsolicited email, phishing, or any form of hacking or network intrusion.
Encourages child exploitation, abuse, or similar harmful activity.
Is illegal or promotes illegal activity.
Promotes or engages in violence, terrorism, or harm to children, animals, or property.
Infringes upon another's intellectual property rights.
Breaches privacy rights or confidentiality obligations.
Disrupts the proper functioning of BigCloudy's systems or other users' services.

1.4 BigCloudy's Reserved Rights

BigCloudy reserves the right to declare any content 'prohibited' if it is indecent, hateful, abusive, or against community standards. We may immediately terminate access if you fail to follow our rules, policies, or privacy guidelines.

1.5 Usage Restrictions

You may not reproduce, distribute, or modify any part of BigCloudy's website or technology without explicit permission.
You may only access BigCloudy's content as directed by BigCloudy.
Reselling or offering our Services without BigCloudy's written approval is prohibited.
You must not bypass or tamper with security features protecting BigCloudy's Services.

1.6 Identity & Verification

BigCloudy may request government-issued identification (personal or business) for verification purposes. By providing your phone number, you consent to receive calls or SMS from BigCloudy (including marketing messages). Standard charges may apply.

1.7 Communications & Recordings

BigCloudy may contact you regarding your account. Calls may be recorded (where legally permitted), and you consent to such recordings being used for security, compliance, or legal purposes.

1.8 Account Fraud & Suspicious Activity

If BigCloudy detects fraudulent, abusive, or suspicious activity, we may suspend or terminate the Services linked to your account. In such cases, BigCloudy reserves the right to pursue legal remedies and recover losses, including investigation costs and damages.

1.9 Minimum Age Requirement

By signing up for BigCloudy Services, you certify that you are at least 18 years old.

1.10 Copyright & DMCA Compliance

In line with the DMCA (Digital Millennium Copyright Act), BigCloudy has procedures in place for handling copyright infringement complaints. If you believe your copyrighted material is being used unlawfully on our Services, you must report it to abuse@bigcloudy.com

2. Abuse of Resources

BigCloudy maintains a strict zero-tolerance policy toward abuse of resources. You agree that:

2.1 Network Attacks

Attempting to compromise or actually compromising BigCloudy's servers, network devices, or any third-party systems (including port scanning or vulnerability testing) is strictly prohibited.

2.2 Denial of Service Attacks

Launching or attempting to launch DDoS attacks from or against BigCloudy's infrastructure is forbidden.

2.3 Copyright Violations

Hosting pirated movies, software, music, or any form of warez content is prohibited. Authentic copyright complaints will be investigated and may result in termination.

2.4 Defamatory or Malicious Content

You may not host content that is defamatory, scandalous, or private in nature without consent. Content that causes emotional distress or violates intellectual property rights is forbidden.

2.5 Server Harm

Any attempt to damage or disrupt BigCloudy servers will result in immediate account suspension. BigCloudy is not responsible for misuse of client accounts. If misuse occurs, accounts may be terminated without refunds.

2.6 Excessive Resource Usage

Sites consuming excessive CPU, RAM, or bandwidth may be asked to upgrade to a higher plan. While BigCloudy guarantees 99.9% uptime, occasional downtime may occur due to essential maintenance and upgrades.

2.7 Staff Abuse

Any disrespectful, abusive, or threatening behavior toward BigCloudy staff will result in immediate service termination without refund.

3. Unsolicited Commercial E-mail / Bulk E-mail (SPAM)

BigCloudy maintains a strict zero-tolerance policy against spam of any kind. Using our Services to send unsolicited or bulk commercial e-mails harms our network reputation and the experience of all customers.

3.1 Prohibition of Spam

You are strictly prohibited from using BigCloudy's servers, email services, or hosting accounts to send unsolicited bulk messages or spam campaigns of any nature.

3.2 Investigation of Violations

If we receive a complaint or detect unusual email activity, BigCloudy may launch a full investigation. During this process, we may temporarily restrict your account to prevent further abuse.

3.3 Consequences of Violation

If we confirm that your account was used to send spam, BigCloudy may restrict, suspend, or terminate your hosting account. We also reserve the right to recover costs related to the investigation and, if required, report the incident to law enforcement for criminal prosecution.

3.4 Spam-Supporting Services

Hosting or supporting websites, applications, or services that aid spammers (including tools that result in our IPs being blacklisted) is forbidden. Violators will face immediate suspension and an administrative penalty.

3.5 Repeat or Severe Violations

First violation: You will receive a warning and must remove all offending material before service restoration.
Second violation: Your account may be terminated immediately, and a penalty will apply.
Severe violations: May result in permanent termination without notice and forfeiture of any fees paid.

3.6 Newsgroups & Mailing Lists

Posting commercial messages to newsgroups or mailing lists where such content is not permitted is considered spam and is prohibited. Only solicited or compliant messages in line with the rules of a specific mailing list or group are allowed.

3.7 Open Relays & Anonymous Mailers

Hosting open relay SMTP servers, anonymous remailers, or any system that allows third parties to send unverified bulk emails is strictly forbidden.

3.8 Outgoing Spam from Our Servers

Sending unsolicited emails directly from BigCloudy servers or using email accounts hosted by us for spam will result in immediate deactivation of your account without a refund.

3.9 Outgoing Mail Limits

To maintain healthy server performance, BigCloudy sets strict outbound mail limits:

Shared Hosting Accounts: Up to 100 emails/hour per domain.
Reseller Accounts: Up to 25 emails/hour per domain.
VPS/Cloud Accounts: Up to 1,000 emails/hour.
Dedicated Servers: Up to 2,000 emails/hour.

3.10 Email Delivery Guarantee

BigCloudy does not guarantee inbox placement for outgoing emails. Factors such as recipient filtering, blacklists, and third-party spam rules are beyond our control.

4. Transfers / Migrations

BigCloudy offers migration support to make moving your website easier. However, some responsibilities remain with the customer.

4.1 Migration Assistance

BigCloudy provides free migration services to help transfer your website data from your previous hosting provider to our servers. While we will make every effort to ensure smooth migration, you are responsible for:

Providing valid access credentials.
Confirming that all files, databases, and configurations have transferred successfully.

4.2 Migration Limitations

Due to differences in hosting platforms and configurations, migrations may not always be successful. Some providers use proprietary formats or systems that cannot be migrated automatically.

4.3 Complimentary Transfer Period

Free migration services are available for 30 days from your sign up date.
After 30 days, migrations may incur additional charges. Please raise a support ticket with our Migration Team for assistance.
BigCloudy cannot be held responsible for data loss during migration. Customers should always keep independent backups.

4.4 Exclusion for Unmanaged Hosting

Free migration is not offered on unmanaged hosting plans. Customers requiring migration assistance on unmanaged services will incur additional charges.

4.5 Paid Migration Cases

If migration requires manual transfer (e.g., different control panels, unsupported systems, or non-standard setups), additional migration charges will apply, even for managed hosting accounts.

5. Bandwidth Regulations

To ensure fair usage across our infrastructure, bandwidth usage is subject to monitoring and limitations. If your account exceeds its allocated bandwidth quota, BigCloudy will notify you. You may choose to purchase additional bandwidth or upgrade to a higher plan. If you decline and continue exceeding the limit, your account may be temporarily suspended until:

The bandwidth reset occurs at the start of the next billing cycle, or
You upgrade your account to accommodate higher bandwidth needs.

Accounts suspended for bandwidth overuse will be reactivated the following month once the limit resets.

6. Unmetered Bandwidth

BigCloudy offers unmetered bandwidth for personal websites and small business sites under normal operating conditions. This means we do not impose a strict cap on data transfer as long as your usage remains within acceptable levels.

If your website or application traffic grows to a level that impacts the stability, uptime, or performance of BigCloudy's servers, networks, or infrastructure, you may be required to upgrade to a VPS or higher hosting plan.

In extreme cases, BigCloudy may temporarily restrict or limit resource usage to protect the overall performance of our services for all customers.

In short: normal use is fine, but excessive resource consumption that risks server health will require an upgrade.

7. Unacceptable Resource Usage

The following rules apply specifically to Shared Hosting, Reseller Hosting, and Cloud Hosting accounts. These environments are multi-tenant, meaning resources are shared among multiple users, and responsible usage is required.

7.1 Hosting Purpose Only

Server storage must be used exclusively for websites and applications.

7.2 No Personal Storage

You may not use hosting space as general storage for personal files, media collections, or unused data unrelated to your website/application.

7.3 Backup & Demo Restrictions

Hosting accounts should not be used to store local system backups, serve as an FTP host, or hold demo/test files unrelated to active websites.

7.4 Cron Job Restrictions

Cron jobs must not run at intervals shorter than 15 minutes. Excessively frequent tasks place unnecessary strain on system resources.

7.5 Database Queries

MySQL queries must not exceed 30 seconds. Long-running queries slow down database performance for all users on the server.

7.6 System Resource Limits

You must not use more than 25% of system resources (CPU, RAM, etc.) for longer than 90 seconds at a time. Activities that may trigger this limit include, but are not limited to:

Running heavy CGI scripts
Excessive FTP transfers
Resource-heavy PHP processes
Large-scale HTTP requests

If your site consistently exceeds these limits, BigCloudy may recommend a VPS or dedicated server upgrade to ensure stable performance.

8. Reseller Hosting Terms & Client Responsibility

If you are a BigCloudy Reseller, the following rules and responsibilities apply:

8.1 Reseller Eligibility

You cannot use a Shared Hosting account to resell hosting services. To resell hosting, you must purchase a Reseller Hosting plan.

8.2 Client Compliance

As a Reseller, you are responsible for ensuring that all your clients follow BigCloudy's Terms of Service and policies.

8.3 Support Responsibility

Resellers are fully responsible for supporting their clients, including:

Customer service inquiries
Billing and account management
Technical support issues

BigCloudy will not provide direct support to your clients. All issues must be reported to us by the reseller on behalf of the client.

8.4 Accountability for Client Actions

Resellers are responsible for all content stored or transferred under their accounts, as well as their clients' activities. If a reseller's client violates laws or BigCloudy's policies, the reseller may be held accountable.

8.5 Indemnification

BigCloudy will not be held liable for the actions or omissions of resellers or their clients. The reseller agrees to indemnify and protect BigCloudy against claims, damages, or legal actions brought by any customer as a result of the reseller's or their client's actions.

8.6 Plan Revisions

BigCloudy reserves the right to review, modify, or update Reseller Hosting plans at any time. Any changes will be communicated publicly or will take effect on a date determined by BigCloudy.

9. BigCloudy as a Reseller or Sub-licensor

9.1 BigCloudy may provide certain third-party services, hardware, or software as a reseller or sub-licensor.

9.2 We are not responsible if updates or modifications by the original provider make any resold product outdated or affect its performance.

9.3 Any failure, defect, or issue with a resold service will not be considered a breach of BigCloudy's obligations under this Agreement.

9.4 Your rights regarding the ownership, licensing, performance, or infringement of a Resold Product are limited to those granted by its original manufacturer.

9.5 You may use any Resold Product provided by BigCloudy only in connection with our Services, as permitted under this Agreement.

9.6 You must not clone, alter, reverse-engineer, tamper with, or use any Resold Product outside of its intended purpose with our Services.

10. Account Details

To use BigCloudy services, you'll need to create an Account. A username and password may be assigned during setup, but we may update them if needed and will notify you through our official email ID.

By creating and using your Account, you confirm that all details you provide are accurate and complete. You're fully responsible for all activities under your Account, whether done by you or not. Keep your login credentials safe, and notify us immediately of any unauthorized access or security issues.

11. Domain Registration

11.1 BigCloudy cannot guarantee the availability of any requested domain. Domains are always registered or transferred under your name. You are responsible for keeping your WHOIS details updated in the BigCloudy client area. If your contact information is invalid or outdated, your domain may be suspended.

We may change the registrar for your domain at our discretion without prior notice to ensure optimal service.

11.2 For relevant gTLDs, you authorize BigCloudy to act as a Designated Agent under ICANN's Transfer Policy. This allows us to approve updates to registrant contact details or ownership changes on your behalf.

11.3 Once a domain is registered, no refunds will be issued.

12. Domain Infringement

You must not register a domain name that is identical or confusingly similar to a trademark or brand operating in the same industry. Doing so will be considered trademark infringement.

Examples (not allowed): flipkartsale.in, bajajfinancecs.com, adtyabrlafnanc.co.in

13. Domain Renewal

BigCloudy will send renewal reminders one month before your domain expires. However, you are responsible for ensuring timely renewal. We are not liable for any delay or failure to renew. Once renewed, domain fees are non-refundable.

14. Free Domain Offer

A free domain is available with the highest shared hosting plan and all cloud hosting plans.
The domain is free for the first year only. Renewal charges apply from the second year at standard rates.
The offer is valid only on selected domain extensions. We may update or change eligible extensions at any time.
Extensions not covered under this offer will require additional charges, which must be pre-approved by BigCloudy.
The free registration period lasts one year. Standard renewal rates apply afterward.

BigCloudy reserves the right to approve or decline free domain registrations or transfers at its sole discretion.

15. Free Hosting Offer

15.1 Customers purchasing Shared or Cloud Hosting for 4 years get 3 months of free hosting.

15.2 Customers purchasing Reseller Hosting for 3 years get 3 months of free hosting.

15.3 Customers purchasing VPS Hosting (selected plans only) for 2 years get 1 month of free hosting.

15.4 This offer does not apply if additional discounts or coupon codes are used.

15.5 Eligible hosting plans are determined solely by BigCloudy and may change without prior notice.

16. Backup Policy

16.1 Using BigCloudy hosting services is at your own risk. You are responsible for keeping backups of your own data so you can access it when needed. BigCloudy does not guarantee backups of your account or content, and you accept the risk of possible data loss.

16.2 As a BigCloudy user, you agree that BigCloudy cannot be held responsible for any data loss under any circumstances.

16.3 Shared, Cloud, and Reseller Hosting plans include free backups:

Databases: backed up daily, retained for 7 days.
Websites: backed up weekly, retained for 1 day.

Please note: backups do not include emails or media files.

16.4 For VPS and Dedicated Servers, we strongly recommend using our paid backup solutions.

16.5 If you use the cPanel Backup Manager, you must download your backup files and delete them from the server. Every Sunday, all backup files stored on the server are automatically removed without notice. Hosting space cannot be used for storing backups.

17. Service Uptime

We target a 99.9% service uptime, except for planned maintenance, emergency fixes, or issues outside our control. Planned maintenance notices will be emailed in advance.

If your server encounters an issue, our engineers will begin work within 30 minutes of notification. If the issue takes longer, you'll be updated with details and an estimated resolution time via your registered email.

18. Uptime Guarantee Terms

18.1 Scheduled maintenance by BigCloudy or our network partners is excluded from the uptime guarantee.

18.2 BigCloudy is not responsible for failures of third-party services.

18.3 BigCloudy is not liable for delays or failures caused by factors beyond our control, including: government actions, wars, sabotage, natural disasters, strikes, transport failures, telecom or third-party service outages (including DNS), or issues with third-party hardware/software.

19. Reasons We May Suspend or Disable Your Services

We may suspend or disable services in the following cases:

19.1 To fix technical problems or apply system updates (you'll be notified before deactivation).
19.2 To comply with new laws or regulatory requirements.
19.3 To make requested changes to your services.
19.4 If required by law.
19.5 If you violate any material terms of this agreement.
19.6 To resolve third-party claims or disputes.
19.7 To prevent financial loss or legal liability.

20. Money-Back Guarantee

20.1 Shared Hosting, Cloud Hosting, VPS Hosting, and Reseller Hosting plans include a 30-day money-back guarantee. Refund requests must be initiated within 30 days of signup. Refunds are not available after this period.

20.2 Refunds cover hosting fees only. Domain registration, renewal, transfer, and license fees are non-refundable. These costs are final once purchased.

21. Billing Policy

21.1 Payments made via Credit Card, Debit Card, Net Banking, UPI, or PayPal will set up accounts instantly once payment is confirmed. Payments via cheque may take 5 working days to clear before setup.

21.2 Refunds are not applicable for: Domain services, control panels (cPanel, Plesk, etc.), LiteSpeed, Softaculous, Dedicated Servers, AWS Cloud, Paid Support, SSL Certificates, Sitelock, SpamExperts, WHMCS, Windows OS, SQL, G Suite, Titan Email, Office 365, or any other paid licenses.

21.3 Any pricing or policy changes made by software license providers will apply immediately to BigCloudy clients.

21.4 No refunds will be issued if your service is suspended or terminated due to violation of terms.

21.5 Refunds do not include taxes, setup fees, postal charges, processing fees, or bank fees. Refunds are not issued for accounts involved in illegal activities, system misuse, or beyond the 30-day refund window.

21.6 If your hosting plan includes a free domain, and you cancel hosting, the cost of the domain (as per standard pricing) will be deducted from your refund. If the refund amount is less than the domain cost, you must pay the difference, or the domain ownership will remain with BigCloudy.

21.7 A transfer fee applies if you want to move the free domain to another provider. Without this fee, the domain will not be released.

21.8 Cancellations must be submitted through the client area.

21.9 Refund processing may take up to 14 days after the cancellation request is approved.

22. Late or Non-Payment

22.1 Unpaid invoices may result in suspension or termination. Suspended accounts are reactivated only after full payment.

22.2 Terminated accounts are permanently deleted. Renewal after termination is treated as a new signup and may include extra charges.

22.3 New services or packages will not be activated for customers with unpaid balances.

23. Pricing and Promotions

23.1 BigCloudy offers multiple hosting products, plans, and services at competitive and transparent prices.

23.2 From time to time, we may run promotions, discounts, coupons, or special pricing for new customers. These apply only for the first billing cycle/initial term. Standard renewal rates will apply afterward.

23.3 Unless specifically stated otherwise, services automatically renew at the standard renewal pricing once the initial term ends.

24. Taxes

All prices on our website are exclusive of taxes. Taxes will be added at checkout and shown on your invoice. Taxes are non-refundable. GST applies only to Indian customers.

25. Cancellation

25.1 You may cancel services at any time through your BigCloudy client area. All outstanding dues must be cleared before cancellation.

25.2 You can choose either immediate cancellation (your account will be suspended right away) or end of term cancellation (your account remains active until the current billing period ends).

25.3 Please back up your data before requesting cancellation. Once canceled, all your data will be permanently deleted and cannot be restored.

26. Account Termination

Your hosting account may be terminated for the following reasons:

26.1 Voluntary cancellation – If you request immediate termination, your account will be suspended instantly and terminated within 24 hours.
26.2 End of term cancellation – If you request cancellation at the end of your subscription, your account will be suspended after expiry and terminated within 24 hours.
26.3 Failure to pay – If you don't pay for services on time, your account may be suspended or terminated. We may also recover collection costs, including legal fees. Deleted data cannot be restored.
26.4 Missed renewal – If you fail to renew on time, your account will be suspended within 24 hours and permanently terminated within 72 hours.
26.5 Violation of terms – Any serious violation of our Terms of Service can result in immediate suspension and termination.
26.6 Fraud detection – If our anti-fraud system flags your account and you fail to provide requested verification, your account may be terminated.
26.7 Disputes or chargebacks – If a payment dispute/chargeback occurs, your account will first be suspended. You'll have 7 days to resolve it, failing which your account will be terminated.

Note: Always keep a backup of your data. Once an account is terminated, all files are permanently deleted and BigCloudy cannot be held responsible.

27. Invoice Disputes

If you believe there's an error in billing, please contact our billing team at billing@bigcloudy.com.

28. Account Security and Systems Use

28.1 You are responsible for all activity on your account and must prevent unauthorized access.

28.2 Keep your password secure at all times.

28.3 Do not share your password with others. You are fully responsible for any misuse caused by unauthorized access.

28.4 Attempting to steal or guess another user's credentials will result in termination.

28.5 You must take adequate security measures to avoid account misuse.

28.6 Do not attempt to bypass authentication, gain unauthorized access, or use hacking tools.

28.7 Denial-of-service attacks, flooding, or attempts to crash systems are strictly prohibited and may lead to legal consequences. BigCloudy will cooperate with law enforcement if required.

28.8 You are responsible for securing any scripts/programs installed on your account. Use strong passwords and correct file permissions. Weak passwords may result in suspension until corrected.

28.9 Our systems and network are for authorized use only. We may monitor activity for security, troubleshooting, or compliance reasons.

28.10 By using our services, you consent to such monitoring, which may involve logging or recording.

28.11 Accessing third-party networks without authorization is prohibited. Proof of authorization may be requested.

28.12 If your account is compromised, it may be disabled. If you fail to clean it up, we may do so for an additional fee.

28.13 We may migrate your account between data centers for legal, technical, or operational reasons without prior notice.

29. Indemnification

29.1 You agree to protect, indemnify, and hold BigCloudy harmless from any claims, losses, damages, liabilities, expenses, or legal fees that may arise from services you use, provide, or products you sell through our services. This applies to claims involving BigCloudy, its employees, agents, customers, officers, or partners.

29.2 You also agree to defend and indemnify BigCloudy against claims that arise from:

Any injury to people or property caused by products you sell or distribute using BigCloudy's services.
Loss of any electronic files you or your customers provide.
Copyright or IP violations, and defective products sold through BigCloudy's services.

30. Limitations of Liability

30.1 To the fullest extent allowed by law, you agree that BigCloudy, its employees, officers, agents, licensors, subcontractors, and service providers will not be held responsible for direct or indirect damages of any kind even if caused by negligence.

30.2 Damages may occur due to factors beyond our control, such as service delays, outages, or failures. These can include loss of profits, revenue, data, business, or cost savings. Examples include force majeure events, third-party actions, hardware/software issues, or customer misuse. You may also face risks such as data loss, corrupted content, technical support limitations, or downtime.

30.3 In any case, BigCloudy's maximum liability will not exceed the total fees you paid to us for the affected service(s) during the 12 months before the claim arose. Some regions do not allow exclusion of certain damages—if that applies, our liability will be limited to the maximum permitted by law, without affecting your consumer rights.

31. Dispute Resolution & Jurisdiction

31.1 Except as explicitly stated in this agreement, no third party has rights under this agreement. However, third-party service or product providers mentioned in this contract are considered intended beneficiaries of the terms that apply to their services, and may enforce those terms directly.

31.2 You agree that all disputes related to this agreement, including interpretation, enforcement, or termination fall under the exclusive jurisdiction of the Courts of Nashik, Maharashtra (India). The agreement will be governed by the laws of India.

32. Price Changes

Our service pricing may change if our vendors (such as license providers or domain registrars) adjust their rates. As authorized partners, we may need to update our prices accordingly. Please review your billing details regularly to stay informed about any changes.

33. Third-Party Products and Services
